Employment Contract as an Enforceable Instrument in Saudi Arabia
The Ministry of Human Resources and Social Development, in partnership with the Ministry of Justice, launched the “Notarized Employment Contract as an Enforceable Instrument” initiative to protect workers’ rights and speed up the resolution of wage disputes in Saudi Arabia.
Under this initiative, documented employment contracts registered on the Qiwa platform become directly enforceable legal instruments, allowing employees to claim unpaid wages through the Najiz platform – the Ministry of Justice’s official digital platform that provides electronic judicial and enforcement services – without filing a labor lawsuit. Wage components covered include basic salary, housing allowance, transportation allowance, and other cash benefits, verified electronically through the Mudad platform – the official government platform that automates payroll processing and verifies wage payments of private sector employees.
If an employer fails to pay full wages within 30 days, or partially pays wages for 90 days, the worker can immediately apply for enforcement. The employer then has five days to pay or object.
To benefit, contracts must be officially documented in Qiwa and notarized via the Ministry of Justice Documentation Center.
