CIVIL CODE PUBLISHED: One of KSA's Largest Legal Reform
On 19 June 2023, the Civil Code consisting of 721 Articles was enacted by Royal Decree M/191 dated 29/11/1444 H.
This marks one of the most significant shifts in the legal landscape of the Kingdom of Saudi Arabia.
Civil matters were previously governed by the Islamic Law (Sharia). They would now be subject to the newly codified law. It elaborates on rights, obligations, and intricate risk allocation among contracting parties, in torts and other vital legal relations.
Set to come into effect 180 days after being published, i.e.,16 December 2023, the Civil Code explicitly renders all contradicting provisions null and void.
Consequently, all contracts entered into before or after the Code comes into effect, will generally become subject to the new KSA Civil Code.
